Terms of Service

These Terms of Service (“Terms”) govern your use of Cascade (the “Service”), operated by Cascade (“we,” “us,” or “our”) at joincascade.app. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Cascade lets you send an event invitation to people you choose — one at a time in sequence, or to several people at once — and manages the responses, deadlines, and confirmations on your behalf, delivering messages by SMS and/or email.

You must be at least 18 years old to use the Service.

You are responsible for the activity under your account and for keeping your sign-in secure. Provide accurate information and keep it up to date.

You may only add and invite people you personally know and whose phone number or email address you are authorized to use to contact them. You represent and warrant that you have the necessary relationship and permission to send each recipient an invitation.

You will not use Cascade to send marketing, promotional, unsolicited, or bulk messages, or to contact people who have not given you their contact information. You are responsible for the content of the invitations you create.

Cascade sends transactional text messages — invitations and confirmations — only to mobile numbers that have opted in to receive them, at joincascade.app/opt-in or when opening an invitation. By using the Service to send or receive these messages, you acknowledge that:

• message frequency varies based on the invitations sent and received;
• message and data rates may apply;
• you can reply STOP to any message to opt out of further texts, and HELP for assistance;
• consent to receive text messages is not a condition of any purchase;
• mobile carriers are not liable for delayed or undelivered messages.

You agree not to use the Service to:

• violate any applicable law or regulation;
• send spam or harassing, deceptive, or unsolicited messages;
• transmit content that is unlawful, hateful, sexually explicit, or otherwise prohibited by mobile-carrier guidelines (including content relating to sex, hate, alcohol, firearms, or tobacco);
• infringe the rights of others; or
• interfere with, disrupt, or attempt to gain unauthorized access to the Service.

The Service, including its software, design, and content (excluding the invitation content you create), is owned by Cascade and protected by applicable laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any message will be delivered.

To the maximum extent permitted by law, Cascade will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, use, or goodwill, arising out of or relating to your use of the Service.

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that could harm other users, third parties, or us.

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date at the top of this page. Your continued use of the Service after changes take effect means you accept the revised Terms.

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules.
